City of Buda Enforcement of Face Covering Executive Order - VIDEO
The City’s Code Enforcement Officer and Building Official are regularly monitoring commercial establishments that are open to the public in Buda. They will issue a notice to appear for those who continuously violate the executive order.
If a person is in violation of the order, a first-time violator will receive a verbal warning. A second violation could result in a fine of $250, with each occurrence being a separate violation. Business owners, workers, and patrons would all be in violation of the order if they are inside a commercial building open to the public, without wearing a mask when social distancing is not feasible.
Additionally, patrons may be subject to arrest for criminal trespass, if they are not wearing a mask and refuse to leave a business after being asked to do so. Normally, if management calls the police, the police will ask the person to leave and provide a criminal trespass warning, if noncompliance continues the violator may be subject to arrest. The prosecution of criminal trespass would be handled by the Hays County Criminal District Attorney’s Office.
